The three timing rules

1. Notice

Serve the notice at least 2 months before the new rent starts, in every case.

2. Once a year

52 weeks after the tenancy began for the first increase, then 52 weeks after each previous increase, or 53 weeks if the date would land more than 6 days before the anniversary.

3. Start of a period

The new rent starts on the first day of a rent period: the same date each month, or the same weekday each week.

Under the Renters' Rights Act, rent increases by any other means, such as rent review clauses in a tenancy agreement, are not permitted for private tenancies, so Section 13 is the route for a landlord-led increase.

Frequently asked questions

How much notice does a landlord have to give for a rent increase?
A Section 13 notice on Form 4A must be served at least 2 months before the new rent starts. This applies to every assured periodic tenancy in England from 1 May 2026, whatever the rent period.
How often can a landlord increase the rent?
Once a year through Section 13. The first increase cannot start until 52 weeks after the tenancy began, and each later increase must be at least 52 weeks after the previous one took effect.
What is the 53-week rule?
Because 52 weeks is slightly less than a year, rent dates would creep earlier each year. If the new date would fall more than 6 days before the anniversary of the first increase after 11 February 2003 (Form 4A question 4.4), the landlord must wait 53 weeks instead.
Which day can the new rent start on?
On the first day of a rent period. For a monthly tenancy that started on the 20th, the new rent must start on the 20th of a month; for a weekly tenancy that started on a Monday, it must start on a Monday.
Can a tenant challenge a Section 13 rent increase?
Yes. The tenant can refer the proposed rent to the tribunal, which decides the market rent. The tribunal must receive the application before the start date in the notice. Otherwise the new rent applies from that date unless the landlord and tenant agree something different.
Does a rent increase have to use Form 4A?
Yes, a Section 13 notice must be on the prescribed form. For private rented assured tenancies in England that is Form 4A; assured agricultural occupancies use a different form.
